Subject

Reply to a request for placement in a C.A.S. for an applicant who expressed the wish to apply for protection about a month after entry: the Prefettura asks for the date of actual entry and, if the expression of the wish took place more than ninety days after it, the elements useful to show good cause for the delay under Article 1(2-bis) of Legislative Decree 142/2015, as well as documentation on any conditions of vulnerability under Article 17.

Note from the Prefettura of Naples (the State's territorial office) — Area IV Immigration, replying to the request to activate reception measures for a Bangladeshi national who arrived in Italy on 4 June 2026 via the Balkan route, and who expressed the wish to apply for international protection to the Immigration Office and the Territorial Commission of Naples by certified email, through counsel, about a month after arrival.

Before proceeding to the assessments within its remit, the Prefettura asks for further information to be sent and, in particular:

The note is significant as practice because it shows the first use, at the stage of access to reception, of the ninety-day time filter introduced into Legislative Decree 142/2015: a criterion that operates upstream of the assessment of reception measures and may lend itself to investigative delay. From the defence standpoint, what matters is the immediate allegation of any vulnerability profiles and the communication of the date of entry together with a request for access to reception.
