Complete file of the documents handed to an applicant placed in the accelerated border procedure after disembarkation at Porto Empedocle: certificate of expression of the wish to apply under Article 27 of Regulation 2024/1348, record of taking custody of the passport, screening form, information sheet, determination of the accelerated border procedure, summons for the interview and prefectural order on stay at the Sikania Centre.
File collected by independent observers: the first complete documentation on
the application of the procedure introduced with the entry into application of the Pact, collected following a
disembarkation at Porto Empedocle on 18 June 2026. It contains the forms and documents actually handed
to the foreign national, previously redacted of personal data. It is the documentary counterpart of the
decisions of the Court of Palermo on the same procedure (R.G.
8694/2026 and R.G. 9739, 9760 and
9759/2026).
The main documents:
- Certificate of expression of the wish to apply for international protection of the Questura of Agrigento, in
Italian and Urdu, with C.U.I. and manifestation ID: it certifies the registration of the application «under
Article 27 of Regulation (EU) 1348/2024», gives 21 days to lodge it with the competent authority
(Article 28) and is valid «until the issue of the document following lodging» under
Article 29(3) of that Regulation, «and is withdrawn at that time». The form also contains the pre-printed
formula on registration «following a transfer under Article 46 of Regulation
(EU) 1351/2024». It expressly warns that the certificate is not proof of identity.
- Record of taking custody of the passport pursuant to Article 11(1) of Legislative Decree 25/2008.
- Screening form and information sheet given to the applicant.
- Determination of the type of procedure by the Territorial Commission of Palermo —
Agrigento Section, adopted «pursuant to Article 28(1) of Legislative Decree No 25 of 2008»: having regard to
Article 43(1) of Regulation (EU) 2024/1348, it finds that the conditions of the asylum procedure
at the border are met and that the applicant is a national of a third country with an Eurostat
recognition rate of 20% or lower (a formula reproduced verbatim from Article 42(1), point (j),
without further individual reasoning); it classifies the case as a mandatory accelerated procedure at the border under Article 45(1);
and «finds that the conditions laid down in
Articles 21(2) and 53 are not met», on the ground that «no elements to that effect emerge from the information given at registration of the
application». This is exactly the reasoning that the Court of Palermo held to be «merely assertive».
