Subject

First guidance to the Bar Councils of the Tuscan district on how to enter on the docket appeals subject to the new EU Pact rules, pending the ministerial subject codes.

Note from the President of the Court of Florence addressed to the Bar Council of Florence, with a request to forward it to the bar councils of the Tuscan district, giving first guidance on the entry on the docket of cases subject to the new rules introduced by the EU Pact and by Decree-Law 100/2026.

The problem is practical and immediate: the IT system for cataloguing appeals does not yet make it possible to distinguish the procedures, because the relevant subject codes have not been defined by the competent ministerial department. Since Decree-Law 100/2026 establishes a so-called «stralcio» process office (a “carve-out” office), to which all the pending procedures predating the entry into force of the new rules will be assigned, correct identification of the procedure is essential both for assignment to the stralcio and to ensure priority and speed for the new cases.

The note therefore invites counsel to indicate in the heading of the originating document one of the following alternative designations:

  1. Pre-Asylum Pact procedure — appeals subject to the regime prior to Regulation (EU) 2024/1348;
  2. Ordinary procedure of the Asylum Pact;
  3. Accelerated procedure of the Asylum Pact;
  4. Border procedure of the Asylum Pact.

Counsel are also asked to indicate in the heading the presence of a request for suspensive effect and to refrain from making one in proceedings that are automatically suspended ex lege. Finally, the note recalls that the international protection section has district-wide territorial jurisdiction.
